NOTICE IS HEREBY GIVEN THAT THE LOWRY CROSSING CITY COUNCIL WILL MEET IN REGULAR SESSION AT 7:00 P.M. ON TUESDAY, FEBRUARY 3, 2009 AT LOWRY CROSSING CITY HALL, 1405 S. BRIDGEFARMER  RD, LOWRY CROSSING, TEXAS,  FOR  THE FOLLOWING PURPOSE:

  3. Roll Call
  4. Discussion and consideration of approval of Minutes of the Lowry Crossing City Council –  January 5, 2009 Meeting
  5. Approval of Consent Items: Financial Statement and Permits for January 2009
  6. Presentation by Citizens
  7. Recognition of Individuals by Mayor and Council
  8. New Business:

(A)      Discussion and consideration of adoption of an order calling an election to be held on May 9, 2009 to elect a mayor and two (2) council members.

(B)      Discussion, consideration, and action of re-platting the property dividing City Hall and the Fire Department into two separate properties.

(C)       Discussion, consideration, and action of authorizing road repairs to Cottrell Lane.

(D)       Discussion, consideration, and action of authorizing road repairs to Overland Drive.

(E)        Discussion, consideration, and action of authorizing road repairs to CR 403.

(F)        Discussion and consideration of adoption of an ordinance adopting the 2006 International Building Code.

(G)       Discussion and consideration of adoption of an ordinance adopting the 2006 International Plumbing Code.

(H)       Discussion and consideration of adoption of an ordinance adopting the 2006 International Electrical Code.

(I)         Discussion and consideration of adoption of an ordinance adopting the 2006 International Mechanical Code.

(J)         Discussion, consideration and action to approve funding for 1 stop sign at CR 403 and 21 chevron signs for curves on Bridgefarmer Road.

(K)       Closed (executive) session of the City Council pursuant to Section 551.071, Texas Government Code, to conduct a private consultation with its attorney(s) to seek the advice of its attorney(s) about pending litigation, to wit:  Arney v. City of Lowry Crossing, Case No. 4:08-CV-00292, United States District Court, Eastern District of Texas, Sherman Division and/or a settlement offer in connection therewith.

(L)        Discussion and consideration of any action regarding pending litigation, to wit:  Arney v. City of Lowry Crossing, Case No. 4:08-CV-00292, United States District Court, Eastern District of Texas, Sherman Division, including discussion and consideration of any action regarding a settlement offer in connection with such pending litigation.

  1. Update from and discussion with Fire Code Enforcer regarding fire code and fire related matters.
  2. Update from and discussion with City Secretary regarding matters pertaining to the office of City Secretary
  3. Adjournment

 

CITY COUNCIL RESERVES THE RIGHT TO RECESS TO AN EXECUTIVE (CLOSED) SESSION ON ANY AGENDA ITEM PURSUANT TO:

Chapter 551 of the Texas Government Code, including:

Section 551.071 consultation with the City’s Attorney

Section 551.072 deliberations regarding real property

Section 551.074 relating to personnel matters

Section 551.076 deliberations regarding security devices or security audits

Section 551.087 deliberations regarding economic negotiations
